These Terms of Service (“Terms”) govern your use of the Contractor Palace website and services (“Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use our Platform.
1. About Contractor Palace
Contractor Palace is an online platform that connects Ohio homeowners with licensed, insured home service contractors. We provide matching services, communication tools and payment processing to facilitate home improvement projects.
Important:Contractor Palace is a technology platform, not a contractor. We do not employ contractors, perform any construction work or guarantee the quality of any contractor’s services. We facilitate connections between homeowners and independent contractor businesses.
2. Eligibility
To use Contractor Palace, you must:
- Be at least 18 years of age
- Be a legal resident of the United States
- Have the legal authority to enter into binding contracts
- Provide accurate and complete registration information
Contractors must additionally maintain valid Ohio business licenses, appropriate trade licenses and general liability insurance as required by their services.
3. User Accounts
Account Creation
You may browse our Platform without an account, but must create an account to request quotes or book services. You agree to provide accurate, current and complete information during registration and to update such information as needed.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.
Account Termination
You may delete your account at any time through your account settings or by contacting us. We may suspend or terminate accounts that violate these Terms or for any reason at our discretion.
4. Homeowner Terms
Service Requests
When you submit a service request, you authorize us to share your project details and contact information with contractors we match you with. You agree to provide accurate descriptions of your project, including honest assessments of scope, timeline and any known complications.
Contractor Selection
While we verify contractor licensing and insurance, you are responsible for evaluating whether a contractor is right for your specific project. Review contractor profiles, ratings and reviews before accepting a quote.
Direct Agreements
Any agreement you enter into with a contractor is between you and that contractor. Contractor Palace is not a party to your contract with the contractor and is not responsible for the contractor’s performance, work quality or conduct.
5. Contractor Terms
Verification Requirements
Contractors must maintain and provide proof of:
- Valid Ohio contractor license (if required for their trade)
- General liability insurance (minimum $500,000)
- Workers’ compensation insurance (if they have employees)
- Any required trade-specific licenses or certifications
Service Standards
Contractors agree to:
- Respond to customer inquiries within 24 hours
- Provide accurate quotes for requested services
- Complete work as described and agreed upon with customers
- Maintain professional conduct in all customer interactions
- Comply with all applicable Ohio laws and building codes
Independent Contractor Status
Contractors are independent businesses, not employees or agents of Contractor Palace. Contractors are responsible for their own taxes, insurance, licensing and compliance with applicable laws.
6. Payments and Fees
Homeowner Payments
Payments for services are made through our Platform using Stripe. A deposit is required to confirm bookings; the remaining balance is due upon completion. All payment terms are displayed before you confirm a booking.
Platform Fees
Contractor Palace charges contractors a service fee on completed jobs. Homeowners pay no platform fees beyond the quoted service price.
Refunds and Disputes
Refund policies are set by individual contractors. For payment disputes, first attempt to resolve the issue directly with your contractor. If unresolved, contact us at [email protected] and we will attempt to mediate. Final decisions on chargebacks are made by the payment processor.
7. User Conduct
You agree not to:
- Provide false or misleading information
- Circumvent the Platform to avoid fees (e.g., arranging direct payment off-platform after being matched)
- Harass, threaten or abuse other users
- Post fake reviews or manipulate ratings
- Use the Platform for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Scrape, crawl or collect data from the Platform without permission
- Interfere with the proper operation of the Platform
Violation of these rules may result in account suspension or termination.
8. Intellectual Property
The Platform, including its design, text, graphics, logos and software, is owned by Contractor Palace and protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from our content without written permission.
By posting content (such as project photos or reviews) on the Platform, you grant us a non-exclusive, royalty-free license to use, display and distribute that content in connection with our services.
9. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Platform will be uninterrupted, error-free or secure.
WE DO NOT WARRANT OR GUARANTEE:
- The quality, safety or legality of any contractor’s services
- The accuracy of contractor profiles, credentials or reviews
- That any contractor will complete work to your satisfaction
- The suitability of any contractor for your specific project
While we verify contractor licensing and insurance, we encourage you to independently verify credentials for your peace of mind.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTRACTOR PALACE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential or punitive damages
- Loss of profits, data or business opportunities
- Any damages arising from contractor services or conduct
- Any claims exceeding the amount you paid to Contractor Palace in the past 12 months or $100, whichever is greater
Some jurisdictions do not allow limitations on implied warranties or liability for certain damages, so these limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Contractor Palace, its officers, directors, employees and agents from any claims, damages, losses or expenses (including attorneys’ fees) arising from your use of the Platform, your violation of these Terms or your violation of any third-party rights.
12. Dispute Resolution
Informal Resolution
Before filing any formal claim, you agree to contact us at [email protected] to attempt informal resolution. Most disputes can be resolved through direct communication.
Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in Franklin County, Ohio.
Arbitration
For disputes that cannot be resolved informally, you agree to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive the right to participate in class action lawsuits or class-wide arbitration.
13. Termination
We may suspend or terminate your access to the Platform at any time, for any reason, without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (such as disclaimers, limitations of liability and indemnification) will survive.
14. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Contractor Palace.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
- Modifications: We may modify these Terms at any time. Continued use after changes constitutes acceptance.
